These Terms of Use (“Terms”) govern your access to and use of the websites, landing pages, forms, and online services operated by ZaSpa (“ZaSpa,” “we,” “us,” or “our”), including zaspa.com and any related booking, registration, or SMS opt-in pages (collectively, the “Site”).

By accessing or using the Site, submitting a form, or opting in to receive communications from us, you agree to be bound by these Terms. If you do not agree, do not use the Site.

These Terms supplement any service-specific consents or agreements you sign in connection with actual aesthetic treatments, intake forms, and clinical care.

Who We Are

ZaSpa is a luxury mobile med spa serving Arizona’s East Valley, providing concierge aesthetic services such as neurotoxins (Botox/tox), dermal fillers, and related skincare, delivered directly to clients’ homes, offices, and events.

The Site is intended to inform you about our services, allow you to contact us, request appointments, and opt in to receive messages and promotional offers.

Eligibility

To use the Site, submit forms, or book aesthetic services, you must:

Be at least 18 years old

Be able to enter into a binding contract

Use the Site only for lawful purposes

By using the Site, you represent and warrant that you meet these requirements. ZaSpa’s aesthetic services are intended for adults 18 years and older.

Not Medical Advice / No Provider–Patient Relationship From Site Use.

The information on the Site (including descriptions of tox/Botox, fillers, skincare, FAQs, and any blog or educational content) is for general informational and marketing purposes only and does not constitute medical advice, diagnosis, or treatment.

You should not rely on Site content as a substitute for professional medical advice.

Individual results vary; no specific outcome is guaranteed.

Do not ignore or delay seeking medical care based on something you read here.

Use of the Site alone does not create a provider–patient relationship. A provider–patient relationship is created only when you are formally accepted as a client and sign appropriate consents/intake forms and receive treatment from ZaSpa.

Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You must not:

Use the Site in any way that violates any applicable law or regulation

Submit false, misleading, or incomplete information

Use any robot, scraper, or automated means to access the Site without our permission

We may suspend or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms or otherwise pose risk to ZaSpa, our clients, or our systems.

Account, Forms & Accuracy of Information

Some portions of the Site may require you to submit forms, provide contact details, or schedule appointments.

You agree to:

Update your information as needed to keep it accurate and current

Not impersonate any other person or entity

We reserve the right to refuse or cancel any appointment or request if information appears false, incomplete, or in violation of these Terms.

SMS / Text Messaging Terms (A2P)

By providing your mobile number and opting in via the Site or any ZaSpa form, you consent to receive SMS/text messages from ZaSpa, which may include:

Appointment confirmations, reminders, and updates

Follow-up messages after treatments

Service announcements and limited promotional offers (such as new client specials or seasonal deals)

Message and data rates may apply according to your mobile plan.

You can opt out at any time by replying STOP to any message.

For help regarding messages, reply HELP or contact us using the information below.

Your consent to receive SMS is not a condition of purchase or of receiving medical/aesthetic services.

Carriers are not liable for delayed or undelivered messages.

You are responsible for:

Providing a valid mobile number that you control

Notifying us if your number changes or is reassigned to someone else

Any charges imposed by your carrier

Our collection and use of your phone number and related data is also governed by our Privacy Policy.

Appointments, Services & Cancellations

Information about services, pricing, promotions, and availability displayed on the Site is subject to change at any time without notice.

We reserve the right to modify or discontinue any service or promotion.

Appointment confirmations are subject to provider availability and clinical appropriateness.

Cancellation and rescheduling policies may be communicated at the time of booking or in your confirmation messages.

ZaSpa may refuse or discontinue services where medically inappropriate, unsafe, or otherwise inconsistent with our professional judgment or policies.

Intellectual Property

All content on the Site—including text, graphics, logos, images, icons, audio/video clips, and layout/design—is owned by or licensed to ZaSpa and is protected by copyright, trademark, and other intellectual property laws.

You may:

View, print, or download content from the Site for your personal, non-commercial use only.

You may not:

Copy, reproduce, modify, distribute, publish, or create derivative works from Site content without our prior written consent

Use any ZaSpa trademarks, logos, or branding without permission

Remove proprietary notices or copyright markings from any materials

We do not warrant that:

The Site will be uninterrupted, secure, or error-free

Defects will be corrected

The Site or the server that makes it available are free of viruses or other harmful components

Any results or outcomes from using the Site or ZaSpa services will meet your expectations

Any reliance on Site information is at your own risk.

Limitation of Liability

To the fullest extent permitted by law, ZaSpa and its owners, employees, contractors, and agents will not be liable for any:

Indirect, incidental, special, consequential, or punitive damages.

To the extent any liability cannot be excluded, our total aggregate liability to you for all claims arising out of or related to the Site shall not exceed one hundred dollars (US $100).

You agree to indemnify, defend, and hold harmless ZaSpa and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

Governing Law & Dispute Resolution

These Terms and your use of the Site are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of such courts.

Changes to These Terms

We may update or modify these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page.

Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Site.
